These Terms of Use (“Terms”) govern your access to and use of the Bodystack website and platform (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. About Bodystack
Bodystack is a software platform designed to help individuals view, organize, and better understand their personal health-related results and trends over time.
Bodystack is a technology and information service only. It does not provide healthcare services.
2. Not Medical Advice
Bodystack is not a healthcare provider and does not provide medical advice, diagnosis, or treatment.
Any explanations, insights, summaries, or recommendations provided through the Service — including those generated by automated or AI-based systems — are for informational and educational purposes only.
Always consult a qualified healthcare professional regarding any medical questions, conditions, or decisions. Do not delay, avoid, or disregard medical care based on information provided by the Service.
3. Eligibility
You must be at least 18 years old to use the Service. By using Bodystack, you represent that you meet this requirement.
4. Your Account
To access certain features, you may be required to create an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep your account information up to date.
5. Connecting Third-Party Accounts
Bodystack allows you to connect third-party services in order to import your results and related information into the Service. At launch, this includes Function Health, which currently operates in the United States.
By connecting a third-party account, you authorize Bodystack to access and import the information you choose to connect for the purpose of providing the Service to you.
Third-party services are operated by their own providers and are subject to their own terms and policies. Bodystack does not control and is not responsible for the availability, accuracy, or practices of third-party services.
6. Use of Automated and AI-Based Systems
Bodystack uses automated systems, including artificial intelligence tools, to help generate explanations, insights, summaries, and responses based on the information you connect to the Service.
To provide these features, Bodystack may share relevant information with trusted third-party service providers (such as AI model providers) solely for the purpose of generating responses for you. These providers process information only to deliver the requested functionality and are not permitted to use it for their own independent purposes.
Bodystack does not use your personal health information to train public or general-purpose AI models.
Automated outputs may be incomplete, inaccurate, or not appropriate for your specific situation. All outputs remain informational in nature and are not medical advice.
You are responsible for deciding how, if at all, to use information provided through the Service.
7. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms.
You agree not to:
- misuse or interfere with the operation of the Service
- attempt to access systems or accounts you are not authorized to access
- scrape, reverse engineer, or disrupt the Service
- use the Service in a way that violates applicable laws or regulations
8. Beta Access and Changes
The Service may be offered as a beta product. Features, functionality, and availability may change over time.
Bodystack may add, modify, suspend, or discontinue any part of the Service at any time, with or without notice.
9. Pricing
The Service is currently offered free to beta users.
Bodystack may introduce optional paid features or plans in the future. If pricing changes, notice will be provided through the Service or on the website before changes take effect.
10. Intellectual Property
The Service, including its software, design, and content (excluding information you provide), is owned by Bodystack and protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without prior written permission.
11. Feedback
If you submit feedback, suggestions, or ideas, you grant Bodystack a non-exclusive, worldwide, royalty-free license to use that feedback to improve the Service.
12. Termination
You may stop using the Service at any time.
Bodystack may suspend or terminate access to the Service if you violate these Terms or misuse the Service.
13. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis.
Bodystack makes no warranties regarding the accuracy, reliability, availability, or suitability of the Service and does not guarantee uninterrupted or error-free operation.
14. Limitation of Liability
To the fullest extent permitted by law, Bodystack shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service.
Your use of the Service is at your own risk.
15. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved through binding, individual arbitration, rather than in court, except that either party may seek relief in small claims court if the claim qualifies.
Arbitration will be conducted by a neutral arbitrator on an individual basis. Class actions, class arbitrations, and representative actions are not permitted.
You may opt out of this arbitration agreement by sending written notice to hello@trybodystack.com within 30 days of first accepting these Terms.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date.
Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
